The São Paulo Court suspended the effects of the tender by the state's Secretariat of Economy and Planning that sold the mansion located at number 768 on Avenida Higienópolis, an upscale neighborhood in the capital of São Paulo. The winner was the group that manages the Pátio Higienópolis shopping mall, which sold the property for R$19.55 million. The minimum offer was R$19.54 million, based on assessments made by Companhia Paulista de Obras e Serviços and Nossa Caixa. The injunction is from judge Rômulo Russo Júnior, from the 5th Public Finance Court. The judge granted the precautionary measure suspending the effects of the bidding until a technical report is presented. Rômulo appointed engineer Mário de Souza Júnior to present the study in 30 days. After the expert examination, the judge will decide whether or not to maintain the suspension.
The sale of the mansion was provided for in State Law 11,688/04, which created the Public-Private Partnership regime in the state. The rule authorized the Treasury Department to sell public properties within the capitalization plan of Companhia Paulista de Parcerias. The mansion on Avenida Higienópolis would be the first to be sold. The judge granted the request for an Estonia Email List injunction in a popular action filed by Agatha Kpzakevic Borges Almeida, who alleges that the sale brought a loss of R$43 million to the public coffers. According to the action, the property is located at a “golden address” in the capital of São Paulo and the sale — which took place in August last year — was made based on an assessment from June 2004, without any adjustment.
The author maintains that the evaluation methods are “inadequate” and “old”, that the value found does not reflect market reality, hurting the public interest and harming the treasury. In the judge's opinion, the injunction suspending the effects of public competition is the least burdensome measure for the public interest. “In addition, it should be noted that the process also raises the delicate issue of transferring the construction potential of a listed property, through a public-private partnership, whose analysis requires depth and maturity”, added the judge. The luxurious mansion based on the classic French style is an example of the first buildings in Higienópolis, a neighborhood that emerged from a high-end real estate development, Boulevard Burchard, launched.
